AN ACT to amend the vehicle and traffic law, in relation to establishing
the statewide transportation network company drivers misconduct data-
base
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 1699-a to read as follows:
3 § 1699-a. Statewide transportation network company drivers misconduct
4 database. 1. Notwithstanding any provision of law to the contrary, the
5 department shall establish a statewide database accessible to transpor-
6 tation network companies and government officials approved by the
7 department which shall compile the names of any transportation network
8 company drivers who have had their employment terminated due to miscon-
9 duct, including but not limited to sexual violence, assault and harass-
10 ment, and any other disqualifying criminal convictions in section
11 sixteen hundred ninety-nine of this article.
12 2. Each transportation network company in this state shall report to
13 the department, in a form and manner as defined in regulations by the
14 department, all information necessary to compile and maintain the data-
15 base established pursuant to this section. Each transportation network
16 company shall report any termination of a driver within five business
17 days of such termination.
18 3. To ensure the safety of passengers and the public, a transportation
19 network company shall check the database prior to authorizing a person
20 to drive for such company and annually thereafter, however, the depart-
21 ment may require, pursuant to regulation, more frequent checks.
22 § 2. This act shall take effect on the ninetieth day after it shall
23 have become a law. Effective immediately, the addition, amendment and/or
24 repeal of any rule or regulation necessary for the implementation of
25 this act on its effective date are authorized to be made and completed
26 on or before such effective date.
