        AN  ACT  to  amend the education law, in relation to aid for substantial
          enrollment growth and growth in enrollment of English language learner
          students
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 3602 of the education law is amended by adding two
     2  new subdivisions 22 and 23 to read as follows:
     3    22. Aid for substantial enrollment growth. For the two thousand seven-
     4  teen--two thousand eighteen school year, each school district  shall  be
     5  apportioned  the  greater  of:    (a)  the  positive difference, if any,
     6  between the public school enrollment of the district in the two thousand
     7  fifteen--two thousand sixteen  school  year,  as  computed  pursuant  to
     8  subparagraph  two of paragraph n of subdivision one of this section, and
     9  such enrollment in  the  two  thousand  fourteen--two  thousand  fifteen
    10  school year, subtracted by four tenths of one percentum of the two thou-
    11  sand  fourteen--two  thousand  fifteen  school  year,  multiplied by the
    12  selected foundation aid per pupil; or (b) the  positive  difference,  if
    13  any,  between  the  public  school enrollment of the district in the two
    14  thousand twelve--two thousand thirteen school year, as computed pursuant
    15  to subparagraph two of paragraph n of subdivision one of  this  section,
    16  and  such  enrollment  in the two thousand fifteen--two thousand sixteen
    17  school year, divided by three, subtracted by four tenths of one  percen-
    18  tum  of  the  two  thousand  twelve--two  thousand thirteen school year,
    19  multiplied by the selected foundation aid per pupil.
    20    23. Aid for English language learner pupil growth. For the  two  thou-
    21  sand  seventeen--two thousand eighteen school year, each school district
    22  shall be apportioned the greater of:   (a) the positive  difference,  if
    23  any, between the English language learner pupil count of the district in
    24  the  two  thousand  fifteen--two  thousand sixteen school year, and such

     1  count in the two thousand fourteen--two thousand  fifteen  school  year,
     2  multiplied by two-tenths and multiplied again by the selected foundation
     3  aid  per  pupil;  or  (b)  the  positive difference, if any, between the
     4  public school enrollment of the district in the two thousand twelve--two
     5  thousand  thirteen school year, as computed pursuant to subparagraph two
     6  of paragraph n of subdivision one of this section, and  such  enrollment
     7  in  the  two thousand fifteen--two thousand sixteen school year, divided
     8  by three, multiplied by two-tenths and multiplied again by the  selected
     9  foundation aid per pupil.
    10    § 2. This act shall take effect July 1, 2017.
