        AN ACT to amend the public health law,  in  relation  to  requiring  the
          promulgation  of regulations relating to the commercial trade of human
          reproductive processes and limiting the number of live births  from  a
          single semen donor

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 4365 of the public health law is amended by  adding
     2  a new subdivision 10 to read as follows:
     3    10.  The  commissioner,  in  consultation with the transplant council,
     4  shall promulgate regulations on the commercial trade of human  reproduc-
     5  tive processes involving semen donation. Such regulations shall include,
     6  but shall not be limited to:
     7    (a)  governing  limits  on  the  number  of live births conceived by a
     8  single donor, which shall not exceed ten live births; and
     9    (b) the establishment of a central tracking registry  of  semen  donor
    10  information,    as    reported    by    reproductive    tissue    banks,
    11  insemination/implantation sites and semen processing facilities  in  the
    12  state.   Such registry shall provide a means for gathering and maintain-
    13  ing accurate information on the:
    14    (i) number of live births conceived from a single donor;
    15    (ii) health information of the donor at the time of the donation; and
    16    (iii) other information deemed appropriate by the commissioner.
    17    In addition, regulations shall maintain the anonymity of the donor and
    18  the offspring and govern access to information maintained by the  regis-
    19  try.
    20    § 2. This act shall take effect immediately.
