AN ACT to amend the elder law, in relation to increasing the income
levels for eligible participants in the elderly pharmaceutical insur-
ance coverage program (EPIC)
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 1 and 2 of section 242 of the elder law, para-
2 graph (b) of subdivision 1 and paragraphs (a) and (b) of subdivision 2
3 as amended by section 14 of part B of chapter 57 of the laws of 2006,
4 are amended to read as follows:
5 1. Persons eligible for comprehensive coverage under section two
6 hundred forty-seven of this title shall include:
7 (a) any unmarried resident who is at least sixty-five years of age and
8 whose income for the calendar year immediately preceding the effective
9 date of the annual coverage period beginning on or after January first,
10 two thousand [five] twelve, is less than or equal to [twenty] thirty-
11 seven thousand five hundred dollars. After the initial determination of
12 eligibility, each eligible individual must be redetermined eligible at
13 least every twenty-four months; and
14 (b) any married resident who is at least sixty-five years of age and
15 whose income for the calendar year immediately preceding the effective
16 date of the annual coverage period when combined with the income in the
17 same calendar year of such married person's spouse beginning on or after
18 January first, two thousand [one] twelve, is less than or equal to
19 [twenty-six] sixty-five thousand dollars. After the initial determi-

1 nation of eligibility, each eligible individual must be redetermined
2 eligible at least every twenty-four months.
3 2. Persons eligible for catastrophic coverage under section two
4 hundred forty-eight of this title shall include:
5 (a) any unmarried resident who is at least sixty-five years of age and
6 whose income for the calendar year immediately preceding the effective
7 date of the annual coverage period beginning on or after January first,
8 two thousand [one] twelve, is more than twenty thousand and less than or
9 equal to [thirty-five] thirty-seven thousand five hundred dollars. After
10 the initial determination of eligibility, each eligible individual must
11 be redetermined eligible at least every twenty-four months; and
12 (b) any married resident who is at least sixty-five years of age and
13 whose income for the calendar year immediately preceding the effective
14 date of the annual coverage period when combined with the income in the
15 same calendar year of such married person's spouse beginning on or after
16 January first, two thousand [one] twelve, is more than twenty-six thou-
17 sand dollars and less than or equal to [fifty] sixty-five thousand
18 dollars. After the initial determination of eligibility, each eligible
19 individual must be redetermined eligible at least every twenty-four
20 months.
21 § 2. This act shall take effect January 1, 2012.
