        AN ACT to amend the vehicle and traffic law and the state  finance  law,
          in  relation  to  authorizing  distinctive  license  plates for former

          members of the New York state legislature
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 404-x to read as follows:
     3    § 404-x. Distinctive "former member of the New York state legislature"
     4  license plates. 1. Any former member of the New York  state  legislature
     5  residing  in  this  state  shall  upon  request  be issued a distinctive
     6  license plate bearing the words "former member of  the  New  York  state
     7  legislature".  Application  for  said license plates shall be filed with
     8  the commissioner in such form  and  detail  as  the  commissioner  shall
     9  prescribe.

    10    2.  Any  distinctive  plate  issued  pursuant to this section shall be
    11  issued in the same manner as other number plates upon the payment of the
    12  regular registration fee prescribed by section four hundred one of  this
    13  article  provided,  however, that an additional annual service charge of
    14  twenty-five dollars shall be charged for such plate. Twenty  dollars  of
    15  each such twenty-five dollar annual service charge shall be deposited to
    16  the credit of the "former member of the New York state legislature trust
    17  fund" established pursuant to section ninety-nine-t of the state finance
    18  law and shall be used for environmental protection purposes as set forth
    19  in  subdivision  six  of  section ninety-two-s of the state finance law.

    20  Provided, however, that one  year  after  the  effective  date  of  this
    21  section, funds in the amount of five thousand dollars, or so much there-
    22  of  as  may be available, shall be allocated to the department to offset
    23  costs associated with the production of such license plates.

     1    § 2. The state finance law is amended by adding a new section 99-t  to
     2  read as follows:
     3    § 99-t. Former member of the New York state legislature trust fund. 1.

     4  There  is hereby established in the joint custody of the commissioner of
     5  taxation and finance and the comptroller, a special fund to be known  as
     6  the "former member of the New York state legislature trust fund".
     7    2.  Such  fund  shall consist of all revenues received pursuant to the
     8  provisions of section four hundred four-x of the vehicle and traffic law
     9  and all other moneys appropriated, credited, or transferred thereto from
    10  any other fund or source pursuant to  law.  Nothing  contained  in  this
    11  section shall prevent the state from receiving grants, gifts or bequests
    12  for  the  purposes of the fund as defined in this section and depositing
    13  them into the fund according to law.

    14    3. Monies of  the  fund  shall  be  expended  only  for  environmental
    15  protection  purposes  as set forth in subdivision six of section ninety-
    16  two-s of this article.
    17    4. Monies shall be payable from the fund on the audit and  warrant  of
    18  the  comptroller  on vouchers approved and certified by the commissioner
    19  of environmental conservation.
    20    5. To  the  extent  practicable,  the  commissioner  of  environmental
    21  conservation  shall ensure that all monies received during a fiscal year
    22  are expended prior to the end of that fiscal year.
    23    § 3. This act shall take effect on the one hundred eightieth day after
    24  it shall have become a law; provided, however, that effective immediate-
    25  ly, the addition, amendment and/or repeal  of  any  rule  or  regulation

    26  necessary  for  the  implementation of this act on its effective date is
    27  authorized and directed to be made  and  completed  on  or  before  such
    28  effective date.
