        AN  ACT  to amend the environmental conservation law, in relation to the
          setback requirement in the Peconic and Gardiner's Bays for the Suffolk
          County Lease Program and Sugar Kelp

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  a  of  subdivision 4 of section 13-0302 of the
     2  environmental conservation law, as amended by chapter 656 of the laws of
     3  2021, is amended to read as follows:
     4    a. Underwater lands within [one thousand] five  hundred  feet  of  the
     5  high water mark shall not be included in a shellfish cultivation zone.
     6    § 2. This act shall take effect immediately.
