        AN ACT to amend the education law, in relation to authorizing  counties,
          municipalities  and  school  districts  to  withdraw  sponsorship of a
          community college
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. The education law is amended by adding a new section 6304-b
     2  to read as follows:
     3    § 6304-b. Withdrawal of sponsorship. 1. Notwithstanding the provisions
     4  of  section  sixty-three  hundred  four of this article, a county, other
     5  municipality or school district that is a local sponsor of  a  community
     6  college may withdraw as the sponsor of a community college.
     7    2. A county or other municipality, acting by and through its governing
     8  body,  or  school  district  acting through its board, may enact a local
     9  law, ordinance or resolution approving its withdrawal as a local sponsor
    10  of a community college.  Such local law, ordinance  or  resolution  must
    11  pass  by the vote of a simple majority and shall be signed by the county
    12  executive or the superintendent of the school board, as  applicable.  No
    13  such  law,  ordinance or resolution shall be deemed to take effect until
    14  it shall have been filed with the clerk of the county or municipality in
    15  which the community college is located.
    16    3. Any withdrawal approved pursuant to the provisions of this  section
    17  shall  not  be effective until at least one year after the withdrawal is
    18  approved.  The municipality will remain as the sponsor until the  effec-
    19  tive date of the withdrawal.
    20    4.  In  the event that a county, other municipality or school district
    21  withdraws as a local sponsor, the community college  shall  be  incorpo-
    22  rated  into the state university system on the same terms as a four year
    23  state university facility and the  state  shall  sponsor  the  community
    24  college.  The  withdrawing county, other municipality or school district

     1  shall no longer have any maintenance of support  requirement  and  shall
     2  not  be  entitled  to  appoint  members  to the board of trustees of the
     3  college.
     4    § 2. This act shall take effect immediately.
