        AN ACT to amend the education law, in relation to requiring that tuition
          paid for public higher education be used for the  purposes  of  higher
          education
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. Section 355 of the education law is amended by adding a new
     2  subdivision 4-a to read as follows:
     3    4-a. Notwithstanding any provision of law to the contrary, all  moneys
     4  and  revenue  derived  from  the  payment  of  tuition at any college or
     5  university of the state university of New York shall be deposited in and
     6  credited to a separate account. The moneys  in  such  account  shall  be
     7  expended  solely  for  the  funding of public higher education. Under no
     8  circumstance shall the moneys in such account  be  commingled  with  any
     9  other moneys.
    10    §  2.  Section  6221  of  the education law is amended by adding a new
    11  subdivision F to read as follows:

    12    F. Notwithstanding any provision of law to the  contrary,  all  moneys
    13  and  revenue  derived  from the payment of tuition at any college of the
    14  city university of New York shall be deposited  in  and  credited  to  a
    15  separate  account.  The  moneys in such account shall be expended solely
    16  for the funding of public higher education. Under no circumstances shall
    17  the moneys in such account be commingled with any other moneys.
    18    § 3. Section 6304 of the education law is  amended  by  adding  a  new
    19  subdivision 14 to read as follows:
    20    14.  Notwithstanding  any provision of law to the contrary, all moneys
    21  and revenue derived from the payment of tuition at any community college
    22  shall be deposited in and credited to a separate account. The moneys  in

    23  such  account  shall be expended solely for the funding of public higher
    24  education. Under no circumstances shall the moneys in  such  account  be
    25  commingled with any other moneys.
    26    § 4.  This act shall take effect immediately.
