AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to the agriculture and New York state horse breeding develop-
ment fund
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The opening paragraph of section 330 of the racing, pari-
2 mutuel wagering and breeding law, as amended by chapter 197 of the laws
3 of 2007, is amended to read as follows:
4 There is hereby created within the state racing and wagering board the
5 "agriculture and New York state horse breeding development fund". Such
6 fund shall be a body corporate and politic constituting a public benefit
7 corporation. It shall be administered by the commissioner of agriculture
8 and markets, the chairman of the New York state racing and wagering
9 board or his or her designee, [and] the chairman and members of the
10 state harness racing commission as reconstituted pursuant to article one
11 of this chapter, and two additional members that must be experienced or
12 have been actively engaged in the breeding of standardbred horses in New
13 York state. These additional members shall serve in an advisory capacity
14 and shall not have voting privileges. Of the additional members, one
15 each shall be appointed by the chairman of the New York state racing and
16 wagering board and the commissioner of agriculture and markets and shall
17 serve terms of no more than three years. Members shall continue to hold
18 office until their successors are appointed and qualified. The chairman
19 shall be designated by the members of the fund. The members of the fund
20 shall receive no compensation from the fund for their services as such
21 members but shall be reimbursed by the fund for the expenses actually
22 and necessarily incurred by them in the performance of their duties
23 under sections two hundred twenty-two through seven hundred five of this
24 chapter. Such fund shall have perpetual existence and shall exercise all

1 powers authorized by this chapter and reasonably necessary for accom-
2 plishing its purposes. Such powers shall be exercised in the name of
3 the fund.
4 § 2. This act shall take effect immediately.
