AN ACT to amend the navigation law and the general business law, in
relation to restrictions on jet skis
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1-a of section 49 of the navigation law is
2 renumbered subdivision 1-b and a new subdivision 1-a is added to read as
3 follows:
4 1-a. The provisions of this section shall apply to jet skis, which,
5 for purposes of this section shall mean any small self-propelled water-
6 craft for one or two individuals, which skims across water on a flat
7 keel, and is steered by means of handlebars.
8 § 2. The general business law is amended by adding a new section 391-r
9 to read as follows:
10 § 391-r. Sale of jet skis. Persons under the age of eighteen years
11 shall be prohibited from purchasing jet skis, as such term is defined in
12 section forty-nine of the navigation law unless such person is accompa-
13 nied by a parent or legal guardian.
14 § 3. Subdivision 1-b of section 49 of the navigation law, as renum-
15 bered by section one of this act, is amended by adding a new paragraph
16 b-1 to read as follows:
17 b-1. No person shall operate a jet ski upon the navigable waters of
18 the state or any tidewaters bordering on or lying within the boundaries
19 of Nassau and Suffolk counties unless such person wears a protective
20 helmet and is the holder of a board safety certificate issued by the
21 commissioner, the United States power squadrons, the United States coast
22 guard auxiliary or other state or government, as a result of completing
23 a course approved by the commissioner.
24 § 4. This act shall take effect immediately.
