        AN  ACT  to  amend  the  agriculture and markets law, in relation to the
          disposition of cats

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 2 of section 374 of the agriculture and markets
     2  law,  as  amended by chapter 449 of the laws of 2010, is amended to read
     3  as follows:
     4    2. In the absence of such findings or certification, a  duly  incorpo-
     5  rated  humane society, a duly incorporated society for the prevention of
     6  cruelty to animals, or any pound maintained  by  or  under  contract  or
     7  agreement  with  any  county,  city, town or village may after five days
     8  make available for adoption or have  humanely  destroyed  in  accordance
     9  with  the  provisions  of  this section and subject to subdivisions six,
    10  eight and nine of section one hundred [eighteen] seventeen of this chap-
    11  ter, any animal of which possession is taken  as  provided  for  in  the
    12  preceding  section,  unless  the  same is earlier redeemed by its owner;
    13  provided, however, that any cat whose owner cannot be  identified  by  a
    14  collar, tag, microchip, tattoo or other identifying mark may after three
    15  days  be  made  available  solely  for  the  purposes of adoption and be
    16  released to an adoptive owner following an  examination  by  a  duly-li-
    17  censed veterinarian, the details of which shall be provided to the adop-
    18  tive owner.
    19    §  2.  This  act shall take effect on the ninetieth day after it shall
    20  have become a law; provided, however, that  effective  immediately,  the
    21  addition,  amendment  and/or  repeal of any rule or regulation necessary
    22  for the implementation of this act on its effective date are  authorized
    23  and directed to be made and completed on or before such effective date.
