        AN ACT to amend  the  vehicle  and  traffic  law,  in  relation  to  the
          inspection  of  tinted or shaded windows, airbag systems, and antilock
          brake systems during the required periodic inspection of  motor  vehi-
          cles
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. This act shall be known and may be cited as the "safe  cars
     2  safe streets act of 2016".
     3    §  2.  Subparagraphs  (a) and (b) of paragraph 1 of subdivision (c) of
     4  section 301 of the vehicle and traffic law, subparagraph (a) as  amended
     5  by  section  5 of part V1 of chapter 62 of the laws of 2003 and subpara-
     6  graph (b) as added by chapter 161 of the laws of 1996, are amended and a
     7  new subparagraph (c) is added to read as follows:
     8    (a) A safety inspection shall be made  with  respect  to  the  brakes;
     9  steering  mechanism;  wheel alignment; lights, including but not limited
    10  to the lights which are designed and placed on a vehicle for the purpose
    11  of illuminating the vehicle's license plates; odometer;  tire  pressure;
    12  seat  safety  belts;  shoulder harness safety belts; any window which is
    13  composed of, covered by or treated with any material which has  a  light
    14  transmittance  of  less  than  seventy percent pursuant to section three
    15  hundred seventy-five of this title; and such other mechanisms and equip-
    16  ment as shall be determined by the  commissioner  to  be  necessary  for
    17  proper  and  safe  operations.  Such  inspection shall also be made with

     1  respect to vehicle identification number. Upon inspection,  the  mileage
     2  appearing on the odometer shall be recorded upon the inspection sticker.
     3    (b)  In the case of any passenger car manufactured on or after Septem-
     4  ber first, nineteen hundred ninety-seven,  [during  the  course  of  the
     5  vehicle  safety  inspection, the readiness of] a safety inspection shall
     6  be made with respect to the inflatable restraint system, by means of the
     7  readiness indicator, shall be noted  on  the  invoice  supplied  to  the
     8  consumer.  The  system's  lack  of  readiness  shall [not] be considered
     9  grounds for the vehicle to fail the safety inspection  provided  for  in
    10  subparagraph (a) of this paragraph.
    11    (c)  In the case of any passenger car manufactured on or after Septem-
    12  ber first, two thousand eleven, a safety inspection shall be  made  with
    13  respect  to  the  antilock brake system (ABS). Any failure of the system
    14  shall  be  considered  grounds  for  the  vehicle  to  fail  the  safety
    15  inspection provided for in subparagraph (a) of this paragraph.
    16    § 3. This act shall take effect on the one hundred twentieth day after
    17  it  shall have become a law; provided, however that effective immediate-
    18  ly, the addition, amendment and/or repeal of any  rules  or  regulations
    19  necessary for the implementation of the foregoing provisions of this act
    20  on  its  effective  date  are  authorized  and  directed  to be made and
    21  completed on or before such effective date.
