        AN  ACT  to  amend  the penal law, in relation to causing the death of a
          peace  officer,  police  officer,  firefighter  or  emergency  medical
          service paramedic or technician
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. This act shall be known as and may be cited as the  "Police
     2  Officer Vincent Guidice Memorial Act."
     3    §  2.  Subdivision  4  of section 125.20 of the penal law, as added by
     4  chapter 477 of the laws of 1990, is amended and a new subdivision  5  is
     5  added to read as follows:
     6    4.  Being eighteen years old or more and with intent to cause physical
     7  injury to a person less than eleven years old, the defendant  recklessly
     8  engages in conduct which creates a grave risk of serious physical injury
     9  to such person and thereby causes the death of such person[.]; or
    10    5.  With  intent to prevent a peace officer, a police officer, a fire-
    11  fighter, including a firefighter acting  as  a  paramedic  or  emergency

    12  medical  technician administering first aid in the course of performance
    13  of duty as such firefighter, an emergency medical service  paramedic  or
    14  emergency  medical service technician, from performing a lawful duty, he
    15  or she causes the death of such peace  officer,  police  officer,  fire-
    16  fighter, paramedic or technician.
    17    §  3.  This  act shall take effect on the ninetieth day after it shall
    18  have become a law.
