        AN ACT to amend the public health  law,  in  relation  to  reimbursement
          rates for inpatient hospital services at the Nassau university medical
          center
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Clause (C) of subparagraph (iii) of paragraph (b) of subdi-
     2  vision 5 of section 2807-c of the public health law is amended by adding
     3  a new item (IV) to read as follows:
     4    (IV) In order to adequately reimburse Nassau university medical center
     5  for the safety-net services it provides to the residents of  the  county
     6  of  Nassau,  and  to reflect its status as a free-standing hospital, for
     7  discharges on or after January first, two thousand nine, the  reimbursa-
     8  ble  inpatient  operating  cost  per discharge for the Nassau university
     9  medical center shall be computed based on one  hundred  percent  of  the

    10  Group  Average  of  the  Major Public Hospital Group, in accordance with
    11  section 86-1.72(a) of the regulations of the department, computed  using
    12  the  cost data related to all members of the Major Public Hospital Group
    13  other than the Nassau university medical center or its predecessors, the
    14  county of Nassau and/or the Nassau county medical center.
    15    § 2. This act shall take effect immediately, provided that the  amend-
    16  ments  to  clause (C) of subparagraph (iii) of paragraph (b) of subdivi-
    17  sion 5 of section 2807-c of the public health law, made by  section  one
    18  of  this  act,  shall not affect the expiration of such subparagraph and
    19  shall expire therewith.
