        AN  ACT  to  amend the social services law and the state finance law, in
          relation to requiring enhanced federal medical  assistance  percentage
          funds be directly shared with the counties and the city of New York
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 4 of section 363-a of the social services  law,
     2  as  amended  by  chapter  474 of the laws of 1996, is amended to read as
     3  follows:
     4    4. The department of taxation and finance shall accept and receive any
     5  and all grants of money awarded to the state under  title  XIX,  or  any
     6  successor  title,  of  the  federal social security act.   All moneys so
     7  received shall be deposited by the department of taxation and finance in
     8  a special fund or funds and shall be used by the state  exclusively  for
     9  medical  assistance  and the administration thereof under the provisions
    10  of this title. Such moneys shall be paid from  such  fund  or  funds  on
    11  audit  and warrant of the comptroller on vouchers of or certification by
    12  the department of health. Any and all grants of enhanced federal medical
    13  assistance percentage funds awarded  to  the  state  shall  be  directly
    14  distributed  to  the  counties and the city of New York proportionate to
    15  the county and city of New  York  share  of  the  non-federal  share  of
    16  medical assistance.
    17    §  2.  Section  8  of the state finance law is amended by adding a new
    18  subdivision 21 to read as follows:
    19    21. Notwithstanding any inconsistent provision  of  law,  examine  and
    20  audit  all  funds  received from the enhanced federal medical assistance
    21  percentage and the distributions made to counties and the  city  of  New
    22  York,  and identify whether the distribution of enhanced federal medical

     1  assistance percentage funds was proportional  to  the  portion  of  each
     2  county's share and the city of New York's share of the non-federal share
     3  of  medical assistance.  Upon thorough examination, audit, and identifi-
     4  cation  of proportionality of distributions, make a report to the legis-
     5  lature containing said findings prior to the  convening  of  its  annual
     6  session.
     7    § 3. This act shall take effect immediately.
