          tee on Racing and Wagering
 
        AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
          relation to free and reduced fee passes, cards and badges
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. Section 243 of the racing, pari-mutuel wagering and  breed-
     2  ing  law,  as  amended  by chapter 18 of the laws of 2008, is amended to
     3  read as follows:
     4    § 243. Free or reduced fee passes,  cards  or  badges.  A  corporation
     5  licensed  or  franchised  to conduct pari-mutuel betting on races run on
     6  its racetrack[, shall not]  may  issue  free  passes,  cards  or  badges
     7  [except]  to  [persons  hereafter  described:  officers]  any  qualified
     8  person. A qualified person shall include, but need not  be  limited  to,
     9  officers  and  employees of the corporation conducting the race meeting,
    10  members, officers and employees of the state racing and wagering  board,

    11  members  and  employees of the jockey club, members and employees of the
    12  national steeplechase and hunt association, members  of  turf  organiza-
    13  tions  of other states and foreign countries, public officers engaged in
    14  the performance of their duties, persons actually employed  and  accred-
    15  ited  by  the  press  to  attend such meetings, owners, stable managers,
    16  trainers, jockeys, jockey managers,  grooms,  concessionaires,  spouses,
    17  domestic  partners  and  children of owners, trainers and jockeys, [and]
    18  other persons whose actual duties require their presence at  such  race-
    19  track,  and  any other person or guest deemed appropriate by such corpo-
    20  ration. In addition, free or reduced fee passes, cards or badges may  be
    21  issued  to  the  general  public  or  segments  of the general public in

    22  connection with any promotional campaign or marketing program  sponsored
    23  by  such  corporation  to  increase  attendance at live race meets.  The
    24  issuance of free passes, cards or badges shall be under  the  rules  and
    25  regulations  of  the  state racing and wagering board [and a list of all

     1  persons to whom free passes, cards or badges are issued shall  be  filed
     2  with the state racing and wagering board].
     3    §  2. Section 324 of the racing, pari-mutuel wagering and breeding law

     7  races run at its racetrack [shall not] may issue free passes,  cards  or
     8  badges [except] to [persons hereafter described: officers] any qualified
     9  person.  A  qualified  person shall include, but need not be limited to,
    10  officers and employees of the corporation or association conducting  the
    11  race  meeting,  members, officers, and employees of the state racing and
    12  wagering board, members of harness racing associations of  other  states
    13  and  foreign  countries,  public  officers engaged in the performance of
    14  their duties, persons actually employed and accredited by the  press  to

    15  attend  such  meetings,  owners,  stable  managers,  trainers,  drivers,
    16  concessionaires  [and],  spouses,  domestic  partners  and  children  of
    17  owners,  trainers and drivers, other persons whose actual duties require
    18  their presence at such racetrack, and any other person or  guest  deemed
    19  appropriate  by  such  corporation  or association. In addition, free or
    20  reduced fee passes, cards or badges may be issued to the general  public
    21  or  segments  of  the  general public in connection with any promotional

    23  ation  to  increase attendance at live race meets.  The issuance of free
    24  passes, cards or badges shall be under the rules and regulations of  the

    25  state  racing and wagering board [and a list of all persons to whom free
    26  passes, cards or badges are issued shall be filed with the state  racing
    27  and wagering board].
    28    §  3. Section 422 of the racing, pari-mutuel wagering and breeding law
    29  is amended to read as follows:
    30    § 422. Free or reduced fee passes, cards or badges. A  corporation  or
    31  association  licensed  to  conduct  pari-mutuel betting on quarter horse
    32  races run at its racetrack [shall] may issue free passes, cards or badg-
    33  es to [persons hereafter described: officers] any  qualified  person.  A
    34  qualified person shall include, but need not be limited to, officers and
    35  employees of the corporation or association conducting the race meeting,

    36  members, officers, and employees of the state racing and wagering board,
    37  members of quarter horse racing associations of other states and foreign
    38  countries,  public  officers engaged in the performance of their duties,
    39  persons actually employed and accredited by the  press  to  attend  such
    40  meetings,  owners,  stable  managers, trainers, jockeys, concessionaires

    53  it shall have become a law.
