        AN ACT to amend the vehicle and traffic law, in relation to the quantity

          of disabled person plates issued to a disabled person
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 1 of section 404-a of the vehicle  and  traffic
     2  law,  as  amended by chapter 596 of the laws of 1982, is amended to read
     3  as follows:
     4    1. Legislative intent. It is the sense of the legislature  to  facili-
     5  tate  the usual and special uses of the highways and other motor vehicle
     6  facilities accorded to severely disabled residents of  this  state.  The
     7  commissioner  is  hereby  empowered to issue to such persons, upon their
     8  application, special motor vehicle registrations, [one set  of]  vehicle
     9  identification  plates  for  motor  vehicles owned by such persons to be
    10  used for the transportation of such severely disabled  person  and  [one

    11  set  of]  vehicle  identification plates for each motor vehicle owned by
    12  such persons and used by a severely disabled member of the owner's fami-
    13  ly.
    14    § 2. Subdivision 2 of section 404-a of the vehicle and traffic law, as
    15  amended by chapter 191 of the laws  of  1991,  is  amended  to  read  as
    16  follows:
    17    2.  Registration  of  vehicles owned by severely disabled persons. The
    18  commissioner shall assign to such motor vehicles, including any  van  or
    19  pick-up  truck  used for transporting persons with disabilities which is
    20  not used for commercial purposes, owned by such persons,  a  distinctive
    21  number  and  issue  and  deliver  in such manner as the commissioner may
    22  select to the owner a certification of registration, in such form as the
    23  commissioner shall prescribe and two number plates per vehicle owned  by

     1  such persons, called disabled person plates. Said disabled person plates
     2  shall  conform  to  the requirements of section four hundred one of this
     3  chapter, but shall bear  distinctive  marks  to  distinguish  them  from
     4  number plates to be issued to other persons, qualifying under this chap-
     5  ter.  The  commissioner, in his discretion, may issue, for any registra-
     6  tion year, [only one plate as] a set of disabled person plates  for  [a]
     7  each  motor vehicle[, in which event a set of disabled person plates for

     8  a motor vehicle shall consist of  one  plate]  owned  by  such  disabled
     9  person.  Where a severely disabled person owns more than one vehicle and
    10  such  vehicle or vehicles is or are used by severely disabled members of
    11  the owner's family who reside with the  owner,  the  commissioner  shall
    12  issue one set of plates for each additional vehicle used by such severe-
    13  ly  disabled  person,  provided  that  such user qualifies as a severely
    14  disabled person in the manner required by this section.
    15    § 3. This act shall take effect on the sixtieth  day  after  it  shall
    16  have  become  a  law  provided, however, that effective immediately, the
    17  addition, amendment and/or repeal of any rules or regulations  necessary
    18  for  the  implementation of this act on its effective date is authorized

    19  and directed to be made and completed on or before such effective date.
