        Introduced  by M. of A. ORTIZ -- read once and referred to the Committee
          on Health
 
        AN ACT to amend the public health law, in relation  to  authorizing  and
          directing  the  commissioner  of health to adopt rules and regulations
          requiring the restriction or elimination of the use of  trans  fat  in
          institutions under its jurisdiction
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 1 of section 206 of the public  health  law  is
     2  amended by adding a new paragraph (t) to read as follows:
     3    (t)  establish  rules and regulations to require any institution under
     4  the department's jurisdiction, that also prepares on  site,  or  subcon-
     5  tracts  for,  meals  to its clients, patients or patrons, to restrict or
     6  eliminate the use of trans fat from such prepared foods. For purposes of
     7  this paragraph, "trans fat" means a specific type  of  fat  formed  when
     8  liquid  fats are made into solid fats by the addition of hydrogen atoms,
     9  in a process known as hydrogenation.

    10    § 2. The commissioner of health shall adopt such rules and regulations
    11  not later than one year after  the  effective  date  of  this  act.  The
    12  department  of  health's  annual  report  to the governor, the temporary
    13  president of the senate and the speaker of the assembly shall include  a
    14  report  assessing  the successful implementation of such rules and regu-
    15  lations in reducing and eliminating the use of trans fat in food  prepa-
    16  ration, and any recommendations relating thereto.
    17    § 3. This act shall take effect immediately.
