COOK, HAWLEY, McLAUGHLIN -- read once and referred to the Committee on Education -- recommitted to the Committee on Education in accordance with Assembly Rule 3, sec. 2 -- reported and referred to the Committee on Rules -- amended on the special order of third reading, ordered reprinted as amended, retaining its place on the special order of third reading AN ACT to amend the education law, in relation to removing the require- ment for annual visual inspections of school buildings; and providing for the repeal of certain provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 409-d of the education law, as 2 added by section 1 of part B of chapter 56 of the laws of 1998, is 3 amended to read as follows: 4 1. Program establishment. The commissioner is authorized and directed 5 to establish, develop and monitor a comprehensive public school building 6 safety program which shall include a uniform inspection, safety rating 7 and monitoring system. Such program shall [require the annual inspection8of all public school buildings throughout New York state;] establish a 9 safety rating system for such school buildings to assess the need for 10 maintenance, repairs, rehabilitation, reconstruction, construction and 11 other improvements related to the structural integrity and overall safe- 12 ty of public school buildings including but not limited to building 13 systems related to electrical, plumbing, heating, ventilation, and air 14 conditioning, sanitation and health, fire and accident protection; and 15 require that such ratings be used for the purpose of developing a build- 16 ings condition survey as required pursuant to subdivision four of 17 section thirty-six hundred forty-one of this chapter and a five year 18 facilities plan as required pursuant to clause (i) of subparagraph two EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The commissioner of education shall review the effectiveness of 4 repealing the requirement for the annual inspection of all public school 5 buildings throughout New York state and make recommendations on whether 6 school districts should continue to be exempt from such inspection. Such 7 report shall be issued to the governor and the legislature on or before 8 January 1, 2019. 9 § 3. This act shall take effect immediately, provided however, that 10 the provisions of section one of this act shall expire and be deemed 11 repealed June 30, 2019.
