        Introduced by M. of A. BENJAMIN -- read once and referred to the Commit-
          tee on Election Law
 
        AN  ACT  to  amend the New York city charter, in relation to term limits
          for elected office
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 

     1    Section  1.  Section  1138 of the New York city charter, as amended by
     2  local law number 51 of the city of  New  York  for  the  year  2008,  is
     3  amended to read as follows:
     4    §  1138.  Term  Limits.  Notwithstanding any provision to the contrary
     5  contained in this charter, no person shall be eligible to be elected  to
     6  or  serve  in the office of mayor, public advocate, comptroller, borough
     7  president or council member if that  person  had  previously  held  such
     8  office  for  [three] two or more full consecutive terms, unless one full
     9  term or more has elapsed  since  that  person  last  held  such  office;
    10  provided, however, that in calculating the number of consecutive terms a
    11  person  has  served,  only  terms commencing on or after January 1, 1994
    12  shall be counted.
    13    § 2. This act shall take effect January 1, 2010.
