        AN ACT to amend the insurance law, in relation  to  requiring  notifica-
          tions  to insured persons that an out-of-network physician or special-
          ist may be used in their procedure, test or surgery
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The insurance law is amended by adding a new section 3242
     2  to read as follows:
     3    § 3242. Notice of  out-of-network  physician  or  specialist.    Every
     4  person insured under a policy of accident and health insurance delivered
     5  or  issued for delivery shall be entitled to notification prior to their
     6  procedure, test or surgery from the physician or specialist who  may  be
     7  used  in  such  procedure,  test  or  surgery  that  such physician's or
     8  specialist's services shall not be covered by their insurance policy.
     9    § 2. This act shall take effect immediately.
