        Introduced  by  M.  of  A.  BRAUNSTEIN  -- read once and referred to the
          Committee on Education -- committee discharged, bill amended,  ordered
          reprinted as amended and recommitted to said committee
 
        AN  ACT to amend the education law, in relation to advance enrollment of
          certain students

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  18  of section 3302 of the education law, as
     2  added by section 1 of part A of chapter 328 of  the  laws  of  2014,  is
     3  amended to read as follows:
     4    18.  "Uniformed service" or "uniformed services" means the Army, Navy,
     5  Air Force, Marine Corps, Space Force, Coast Guard as well as the Commis-
     6  sioned Corps of the National Oceanic and Atmospheric Administration, and
     7  Public Health Services.
     8    § 2. The education law is amended by adding a new  section  3304-a  to
     9  read as follows:
    10    §  3304-a.  Advance enrollment.  A student whose parent or guardian is
    11  being relocated to the state under military orders and is transferred or
    12  is pending transfer to a military installation within the state shall be
    13  deemed to be a resident pupil of a school district for the  purposes  of
    14  enrollment  pursuant  to  section three thousand two hundred two of this
    15  title, provided that such parent or guardian provides a school  district
    16  an  address  that  the  student will reside within the boundaries of the
    17  district in which the student is to be  enrolled.    A  school  district
    18  shall  permit  a  student to enroll preliminarily by remote registration
    19  without charge and shall not require the student or the parent or guard-
    20  ian of the student  to  physically  appear  at  a  location  within  the
    21  district for the purpose of enrolling the student provided the parent or
    22  guardian  of  the student provide a school district with military orders
    23  that a parent or guardian will be stationed in  this  state  during  the
    24  current or following school year and an address within the boundaries of
    25  the district in which the student will reside and is to be enrolled.
    26    § 3. This act shall take effect immediately.
