        AN  ACT  to amend the penal law, in relation to aggravated harassment of
          an individual through electronic mail
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 240.30 of the penal law is amended by adding a new
     2  subdivision 1-a to read as follows:
     3    1-a. Transmits an electronic message over a computer  network  without
     4  the  express  authority  of  the  recipient,  when such message provides
     5  neither any purpose of legitimate communication nor any  information  to
     6  the  recipient  which would allow a direct reply to inform the sender of
     7  the annoyance; or
     8    § 2. This act shall take effect on the first of November next succeed-
     9  ing the date on which it shall have become a law.
