AN ACT to amend the general business law, in relation to requiring the
disclosure of prices at appearance enhancement businesses which prac-
tice nail specialty
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 404-b of the general business law, as amended by
2 chapter 80 of the laws of 2015, is amended to read as follows:
3 § 404-b. Nail specialty; owner responsibilities. 1. In addition to any
4 rules and regulations establishing standards for practices and oper-
5 ations by licensees under this article, in order to ensure the health,
6 safety and welfare within appearance enhancement businesses, all owners
7 and operators of appearance enhancement businesses which practice nail
8 specialty shall make available for use, gloves and facemasks for nail
9 [speciality] specialty licensees and trainees who work in such busi-
10 nesses.
11 2. All owners and operators of appearance enhancement businesses which
12 practice nail specialty shall post a notice which conspicuously displays
13 the current price of the products and services provided. Such notice
14 shall be posted in close proximity to the cash register or so situated
15 as to be clearly visible to the buyer at the point of sale. Such notice
16 shall:
17 (a) include, but need not be limited to:

1 (i) a statement that reads "all prices and the disclosure thereof
2 shall be the responsibility of the owner or operator of this business";
3 and
4 (ii) a list of every product or service offered, with a corresponding
5 all inclusive price for each product or service; and
6 (b) disclose factors which may cause the price of products or services
7 to be higher than the posted price, and the range of possible additional
8 charges.
9 3. An owner or operator of appearance enhancement businesses which
10 practice nail specialty shall not offer or charge a customer for a prod-
11 uct or service that is not included on the notice described in subdivi-
12 sion two of this section.
13 4. Any violation of this section shall be punishable by a civil penal-
14 ty not to exceed two hundred fifty dollars for each violation.
15 § 2. This act shall take effect on the thirtieth day after it shall
16 have become a law.
