AN ACT to amend the vehicle and traffic law, in relation to increasing
the penalties for passing a stopped school bus
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision (c) of section 1174 of the vehicle and traffic
2 law, as amended by chapter 254 of the laws of 2002, is amended to read
3 as follows:
4 (c) Every person convicted of a violation of subdivision (a) of this
5 section, in addition to any other penalty imposed by this chapter shall:
6 for a first conviction thereof, be punished by a fine of not less than
7 two hundred fifty dollars nor more than four hundred dollars or by
8 imprisonment for not more than thirty days or by both such fine and
9 imprisonment; for a conviction of a second violation, both of which were
10 committed within a period of three years, such person shall be punished
11 by a fine of not less than six hundred dollars nor more than seven
12 hundred fifty dollars or by imprisonment for not more than one hundred
13 eighty days or by both such fine and imprisonment; upon a conviction of
14 a third or subsequent violation, all of which were committed within a
15 period of three years, such person shall be punished by a fine of not
16 less than seven hundred fifty dollars nor more than one thousand dollars
17 or by imprisonment for not more than one hundred eighty days or by both
18 such fine and imprisonment.
19 § 2. Paragraph b of subdivision 2 of section 510 of the vehicle and
20 traffic law is amended by adding a new subparagraph (xvi) to read as
21 follows:
22 (xvi) for a period of sixty days where the holder is convicted of two
23 or more violations within a period of ten years of subdivision (a) of
24 section eleven hundred seventy-four of this chapter.
25 § 3. This act shall take effect immediately.
