BACALLES, CONTE, DUPREY, ERRIGO, GIGLIO, HAWLEY, KOLB, MILL- ER, OAKS, RAIA, SAYWARD, SPANO, THIELE, WALKER -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to commencement of proceedings relating to the names of candidates on ballots or voting machines The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4 of section 16-102 of the election law, as 2 added by chapter 135 of the laws of 1986, is amended to read as follows: 3 4. A final order in any proceeding involving the names of candidates 4 on ballots or voting machines shall be made, if possible, at least five 5 weeks before the day of the election at which such ballots or voting 6 machines are to be used, or if such proceeding is commenced within five 7 weeks of such election, no later than the day following the day on which 8 the case is heard. Notwithstanding any other provision of law to the 9 contrary, such a proceeding shall not be heard less than fifteen days 10 before the day of the election at which such ballots or voting machines 11 are to be used. 12 § 2.
