Go to top STATE OF NEW YORK ________________________________________________________________________ 6709 2013-2014 Regular Sessions IN ASSEMBLY April 16, 2013 ___________ Introduced by M. of A. FAHY -- (at request of the Office of General Services) -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development AN ACT to amend chapter 303 of the laws of 1988 relating to the exten- sion of the state commission on the restoration of the capitol, in relation to extending such provisions for an additional five years The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2 of chapter 303 of the laws of 1988, relating to 2 the extension of the state commission on the restoration of the capitol, 3 as amended by chapter 92 of the laws of 2008, is amended to read as 4 follows: 5 § 2. The temporary state commission on the restoration of the capitol 6 is hereby renamed as the state commission on the restoration of the 7 capitol (hereinafter to be referred to as the "commission") and is here- 8 by continued until April 1, [2013] 2018. The commission shall consist 9 of eleven members to be appointed as follows: five members shall be 10 appointed by the governor; two members shall be appointed by the tempo- 11 rary president of the senate; two members shall be appointed by the 12 speaker of the assembly; one member shall be appointed by the minority 13 leader of the senate; one member shall be appointed by the minority 14 leader of the assembly, together with the commissioner of general 15 services and the commissioner of parks, recreation and historic preser- 16 vation. The term for each elected member shall be for three years, 17 except that of the first five members appointed by the governor, one 18 shall be for a one year term, and two shall be for a two year term, and 19 one of the first appointments by the president of the senate and by the 20 speaker of the assembly shall be for a two year term. Any vacancy that 21 occurs in the commission shall be filled in the same manner in which the 22 original appointment was made. The commission shall elect a chairman and 23 a vice-chairman from among its members. LBD09093-01-3A. 6709 2 1 commission on the restoration of the capitol shall be deemed to be 2 members of the commission until their successors are appointed. The 3 members of the commission shall receive no compensation for their 4 services, but shall be reimbursed for their expenses actually and neces- 5 sarily incurred by them in the performance of their duties hereunder. 6 § 2. Section 9 of chapter 303 of the laws of 1988, relating to the 7 extension of the state commission on the restoration of the capitol, as 8 amended by chapter 92 of the laws of 2008, is amended to read as 9 follows: 10 § 9. This act shall take effect immediately, and shall remain in full 11 force and effect until April 1, [2013] 2018. 12 § 3. This act shall take effect immediately and shall be deemed to 13 have been in full force and effect on and after April 1, 2013; provided 14 that the amendments to section 2 of chapter 303 of the laws of 1988 made 15 by section one of this act shall not affect the expiration of such chap- 16 ter, and shall be deemed to expire therewith.
