        AN  ACT to amend the vehicle and traffic law, in relation to authorizing
          the issuance of distinctive plates for recipients of the distinguished
          service cross medal
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 404-x to read as follows:
     3    § 404-x. Distinctive plates  for  persons  awarded  the  distinguished
     4  service  cross  medal.  1. Any person who was a recipient of the distin-
     5  guished service cross medal or the spouse of any such person shall, upon
     6  request, be issued a license  plate  bearing  the  words  "Distinguished
     7  Service Cross". If a distinctive plate is issued to a person pursuant to
     8  this section, such a distinctive plate shall not be issued to the spouse
     9  of  such  person. Application for said license plate shall be filed with
    10  the commissioner in such form  and  detail  as  the  commissioner  shall
    11  prescribe.

    12    2. The distinctive plate authorized in subdivision one of this section
    13  shall  be  issued upon proof, satisfactory to the commissioner, that the
    14  applicant or the spouse of the applicant is a recipient or the spouse of
    15  the recipient who received the distinguished service cross, pursuant  to
    16  10 USC 3742.
    17    3. A distinctive plate issued pursuant to this section shall be issued
    18  in  the  same  manner as other number plates upon payment of the regular
    19  registration fee prescribed by section four hundred one of this  article
    20  provided,  however,  that  an  additional one time service charge of ten
    21  dollars shall be charged for such  plate.  Such  annual  service  charge
    22  shall  be  deposited  pursuant to the provisions of section four hundred

    23  four-oo of this article to the credit of the department of  motor  vehi-
    24  cles  distinctive  plate development fund established by section ninety-

     1  five-g of the state finance law and shall be used  for  the  production,
     2  design, advertising and marketing of distinctive license plates pursuant
     3  to such section ninety-five-g.
     4    4.  Nothing  contained in this section shall require the issuance of a
     5  special number plate under  this  section  unless  the  commissioner  is

     6  satisfied  that the aggregate amount of annual service charges collected
     7  pursuant to subdivision three of this  section  will  be  sufficient  to
     8  recover the costs of the design and manufacture of such special plates.
     9    § 2. This act shall take effect on the one hundred eightieth day after
    10  it shall have become a law.
