        AN  ACT to amend the education law, in relation to allowing dental resi-
          dents to satisfy  the  ethics  and  jurisprudence  educational  course
          requirement  for licensure during the period of their dental residency
          and in relation to limited permits in dentistry
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  6 of section 6604-a of the education law, as
     2  added by chapter 183 of the laws of 2007, is amended to read as follows:
     3    6. On or after the effective date of this subdivision,  and  no  later
     4  than  the  end  of  the first registration period commencing on or after
     5  such date during which he or she is required to comply with the continu-

     6  ing education requirements of this  section,  each  dentist  shall  have
     7  completed on a one-time basis, as part of the mandatory hours of accept-
     8  able formal continuing education required by this section, no fewer than
     9  three  hours  in a course approved by the department in dental jurispru-
    10  dence and ethics, which shall include the laws, rules,  regulations  and
    11  ethical  principles  relating  to  the practice of dentistry in New York
    12  state, provided that postgraduate dental students enrolled in  New  York
    13  state  dental  residency  programs  may satisfy the requirements of this
    14  subdivision by taking such an approved course during the period of their
    15  dental residency prior to their initial licensure.
    16    § 2.  Section 6605 of the education law is amended  by  adding  a  new
    17  subdivision 5 to read as follows:

     1    5.  Notwithstanding  subdivision  one  of  this section, dental school
     2  graduates who meet the license requirement  for  education  pursuant  to
     3  subdivision  two of section sixty-six hundred four of this article shall
     4  be deemed to be exempt persons pursuant to section sixty-six hundred ten
     5  of  this  article  and shall not be required to obtain a limited permit,
     6  provided that they are employed in an approved residency program for the

     7  purpose of fulfilling initial licensure requirements pursuant to section
     8  sixty-six hundred four of this article. Not later than sixty days  after
     9  entry  into  an  approved  residency  program, the dental resident shall
    10  register on a form acceptable to the commissioner and pay to the depart-
    11  ment a residency registration fee established by the  department,  which
    12  residency  registration fee shall be reasonable and shall not exceed the
    13  limited permit fee specified in subdivision four of  this  section.  All
    14  persons  deemed  exempt pursuant to this section shall be subject to all
    15  provisions of article one hundred thirty of this  title,  including  but
    16  not  limited to having disciplinary action taken against their residency
    17  registration status.

    18    § 3. This act shall take effect January 1, 2010.
