AN ACT to amend the education law, in relation to establishing Eid-al-
Adha and Eid-Al-Fitr as school holidays
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 3204-a
2 to read as follows:
3 §3204-a. Eid-al-Adha and Eid-Al-Fitr school holidays. 1. The days of
4 the Islamic lunar calendar designated to begin on the tenth day of the
5 month of Dhul Hijja and commonly known as "Eid-al-Adha", and the first
6 day of Shawwai known as Eid-Al-Fitr shall be school holidays for all
7 public schools in a city school district of a city having a population
8 of one million or more.
9 2. The school authorities of every public school in a city school
10 district of a city having a population of one million or more are hereby
11 authorized and directed to cause all public schools within such district
12 to be closed on Eid-al-Adha and Eid-Al-Fitr.
13 § 2. Section 3604 of the education law is amended by adding a new
14 subdivision 7-c to read as follows:
15 7-c. Notwithstanding any other provision of law, for purposes of any
16 calculation under subdivision seven or eight of this section, the
17 commissioner shall disregard any reduction resulting from observance of
18 Eid-al-Adha and Eid-Al-Fitr and, if necessary, such observed holidays
19 shall be calculated as a session day.
20 § 3. This act shall take effect on the one hundred twentieth day after
21 it shall have become a law; provided that any and all rules and regu-
22 lations and any other measures necessary to implement any provision of
23 this act on its effective date may be promulgated and taken, respective-
24 ly, on or before such effective date.
