        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          prohibiting  the  sale  and  distribution  of  glyphosate and products
          containing glyphosate

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The environmental conservation law is amended by adding a
     2  new section 37-0115 to read as follows:
     3  § 37-0115. Prohibition of glyphosate and products containing glyphosate.
     4    1. No person, firm, partnership, association, limited liability compa-
     5  ny or corporation shall distribute, sell, offer for sale or use  glypho-
     6  sate or any products containing glyphosate within New York state.
     7    2. For the purposes of this section, glyphosate shall mean a synthetic
     8  compound  that  is  a  non-selective  systemic  herbicide, also known as
     9  N-(phosphonomethyl) glycerine with a chemical formula of C3H8NO5P.
    10    3. The department is authorized to promulgate  such  rules  and  regu-
    11  lations  as  it shall deem necessary to implement the provisions of this
    12  section.
    13    § 2. This act shall take effect one year after it shall have become  a
    14  law. Effective immediately, the addition, amendment and/or repeal of any
    15  rule  or  regulation necessary for the implementation of this act on its
    16  effective date are authorized and directed to be made and  completed  on
    17  or before such effective date.
