AN ACT to amend the mental hygiene law, in relation to the mapping of
autism locations
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions (d) and (e) of section 13.42 of the mental
2 hygiene law, as added by chapter 469 of the laws of 2016, are amended to
3 read as follows:
4 (d) (1) There is hereby created within the board the autism mapping
5 program. This program is established to map locations of occurrence of
6 autism.
7 (2) The program shall include:
8 (i) provision of grants to approved organizations under subdivision
9 (e) of this section; and
10 (ii) compilation of data including mapping of the frequency of the
11 occurrence of autism in various locations in the state and dissemination
12 of the data to the public.
13 (e) (1) The board shall make grants within the amounts appropriated to
14 approved organizations, as defined in paragraph two of this subdivision,
15 for the provision of services relating to autism mapping. Such services
16 shall include but not be limited to mapping of the frequency of the
17 occurrence of autism in various locations of the state.

1 (2) For the purposes of this section, "approved organization" shall
2 mean an organization approved by the board, to provide services under
3 this subdivision. Such organizations shall include, but not be limited
4 to, the following:
5 (i) a hospital licensed under article twenty-eight of the public
6 health law;
7 (ii) a health maintenance organization licensed under article forty-
8 three of the insurance law or certified under article forty-four of the
9 public health law;
10 (iii) an organization with program expertise in autism related issues;
11 (iv) a county or city health department; or
12 (v) any combination of the above.
13 (3) The board shall develop standards for the implementation of autism
14 mapping programs by approved organizations which shall ensure the
15 following:
16 (i) integration of the approved organization with existing health care
17 providers;
18 (ii) maximizing third party reimbursement; and
19 (iii) providing data collection for mapping of the occurrence of
20 autism in various locations of the state.
21 (f) Such board shall meet at least quarterly. Special meetings may be
22 called by the chair. The agenda and meeting place of all regular or
23 special meetings shall be made available to the public in advance of
24 such meetings.
25 [(e)] (g) The advisory board shall submit a written report to the
26 governor, the temporary president of the senate and the speaker of the
27 assembly by no later than October first of the year next succeeding the
28 effective date of this section and annually thereafter, setting forth
29 the recommendations and activities of the council on matters within the
30 scope of its duties as set forth in this section. Beginning in two thou-
31 sand nineteen, the advisory board shall also include in such annual
32 report information concerning the operation of the autism mapping
33 program. Such reports shall include the experience of the program in
34 mapping of the frequency of the occurrence of autism in various
35 locations around the state. Approved organizations shall provide such
36 data and assessment as the board may require for such report. Such
37 report shall also include any recommendations for additional action to
38 respond to the high incidence of autism in this state.
39 § 2. This act shall take effect on the ninetieth day after it shall
40 have become a law; provided, however, that effective immediately, the
41 addition, amendment and/or repeal of any rule or regulation necessary
42 for the implementation of this act on its effective date are authorized
43 and directed to be made and completed on or before such effective date.
