          Committee on Environmental Conservation
 
        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          wastewater from hydraulic fracturing
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Subdivision 4  of  section  17-1905  of  the  environmental
     2  conservation  law  is  amended  by  adding  a new paragraph f to read as
     3  follows:
     4    f. Promulgate such rules and regulations as may be  necessary  to  (1)
     5  require  that  any  wastewater  from hydraulic fracturing be screened to
     6  determine if it is appropriate for treatment  by  any  sewage  treatment
     7  works  so  as  to  not  cause  harm  to the treatment processes that are
     8  designed to remove nitrogen and organic human or  mammalian  waste;  and
     9  (2)  prohibit the acceptance by any sewage treatment works of wastewater
    10  from hydraulic fracturing containing any contaminants which such  sewage
    11  treatment facility was not designed to treat, including, but not limited

    12  to   radioactivity,  carcinogens,  bases,  acids,  solvents,  slickening
    13  agents, metals, hydrocarbons and high salinity  solutions  derived  from
    14  hydraulic fracturing activities.
    15    § 2. This act shall take effect immediately.
