AN ACT to amend the education law, in relation to the calculation of the
"pupil wealth ratio" for school aid purposes
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs a and b of subdivision 3 of section 3602 of the
2 education law, as amended by section 13 of part B of chapter 57 of the
3 laws of 2008, are amended to read as follows:
4 a. (1) "Pupil wealth ratio" shall mean the number computed to three
5 decimals without rounding obtained when actual valuation of a school
6 district divided by, when applicable, the sum of the total wealth pupil
7 units and, if the district's number of resident students enrolled in
8 non-public school is more than twice the number of resident students
9 enrolled in public school and if the public school enrollment is over
10 one thousand, twenty-five per centum of the resident students enrolled
11 in non-public school of the district, is divided by the statewide aver-
12 age actual valuation per total wealth pupil unit as computed by the
13 commissioner in accordance with the provisions of this section. Such
14 statewide average actual valuation per total wealth pupil unit shall be
15 established each year by the commissioner using the latest single year
16 actual valuation computed under paragraph c of subdivision one of this
17 section. Such statewide average shall be transmitted to the school
18 districts. Such statewide average shall be rounded to the nearest
19 hundredth and shall include the actual valuation and total wealth pupil
20 units of all school districts eligible for aid pursuant to this section
21 except central high school districts. For the purposes of calculating
22 such statewide average the data for the city school district of the city
23 of New York shall be citywide data.
24 (2) "Pupil wealth ratio for total foundation aid" shall mean the
25 number computed to three decimals without rounding obtained when the
26 selected actual valuation of a school district divided by, when applica-
27 ble, the sum of the total wealth pupil units and, if the district's
28 number of resident students enrolled in non-public school is more than

1 twice the number of resident students enrolled in public school and if
2 the public school enrollment is over one thousand, twenty-five per
3 centum of the resident students enrolled in non-public school of the
4 district, is divided by the statewide average selected actual valuation
5 per total wealth pupil unit as computed by the commissioner in accord-
6 ance with the provisions of this section. Such statewide average
7 selected actual valuation per total wealth pupil unit shall be estab-
8 lished each year by the commissioner using the selected actual valuation
9 computed under paragraph c of subdivision one of this section. Such
10 statewide average shall be transmitted to the school districts. Such
11 statewide average shall be rounded to the nearest hundredth and shall
12 include the selected actual valuation and total wealth pupil units of
13 all school districts eligible for aid pursuant to this section except
14 central high school districts. For the purposes of calculating such
15 statewide average the data for the city school district of the city of
16 New York shall be citywide data.
17 b. (1) "Alternate pupil wealth ratio" shall mean the number computed
18 to three decimals without rounding obtained when the adjusted gross
19 income of a school district for the calendar year two years prior to the
20 calendar year in which the base year began divided by, when applicable,
21 the sum of the total wealth pupil units of such district and, if the
22 district's number of resident students enrolled in non-public school is
23 more than twice the number of resident students enrolled in public
24 school and if the public school enrollment is over one thousand, twen-
25 ty-five per centum of the resident students enrolled in non-public
26 school of the district is divided by the statewide adjusted gross income
27 per total wealth pupil unit. Such statewide average gross income per
28 pupil shall be established each year by the commissioner and shall be
29 transmitted to school districts. Such statewide average shall be rounded
30 to the nearest hundredth and shall include the adjusted gross income and
31 total wealth pupil units of all school districts eligible for aid pursu-
32 ant to this section except central high school districts. For the
33 purposes of calculating such statewide average the data for the city
34 school district of the city of New York shall be citywide data.
35 (2) "Alternate pupil wealth ratio for total foundation aid" shall mean
36 the number computed to three decimals without rounding obtained when the
37 selected adjusted gross income of a school district for the calendar
38 year two years prior to the calendar year in which the base year began
39 divided by, when applicable, the sum of the total wealth pupil units of
40 such district and, if the district's number of resident students
41 enrolled in non-public school is more than twice the number of resident
42 students enrolled in public school and if the public school enrollment
43 is over one thousand, twenty-five per centum of the resident students
44 enrolled in non-public school of the district is divided by the state-
45 wide selected adjusted gross income per total wealth pupil unit. Such
46 statewide average selected adjusted gross income per pupil shall be
47 established each year by the commissioner and shall be transmitted to
48 school districts. Such statewide average shall be rounded to the nearest
49 hundredth and shall include the selected adjusted gross income and total
50 wealth pupil units of all school districts eligible for aid pursuant to
51 this section except central high school districts. For the purposes of
52 calculating such statewide average the data for the city school district
53 of the city of New York shall be citywide data.
54 § 2. This act shall take effect immediately.
