AN ACT relating to the application for retirement filed by Edward S.
Harrison
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any other provision of law, the retirement
2 application of Edward S. Harrison, deceased, who was employed by the
3 state of New York for more than 28 years, which was filed with the New
4 York state and local employees' retirement system on January 20, 2006,
5 shall be deemed to have been filed at least 30 days prior to retirement
6 for purposes of determining the retirement benefits for Edward S.
7 Harrison, if, on or before December 31, 2009, the wife or representative
8 of the estate of Edward S. Harrison files a written request with the
9 state comptroller to that effect.
10 § 2. All costs associated with the implementation of this act shall be
11 borne by the state of New York.
12 § 3. This act shall take effect immediately.
FISCAL NOTE.--This bill will deem the service retirement application
filed by the late Edward S. Harrison on January 20, 2006 to have been
filed thirty days prior to his disability retirement date.
If this bill is enacted, there will be an immediate past service cost
of approximately $44,800, which would be borne by the State of New York
as a one-time payment. This estimate is based on the assumption that
payment will be made on March 1, 2010.
This estimate, dated March 24, 2009 and intended for use only during
the 2009 Legislative Session, is Fiscal Note No. 2009-200, prepared by
the Actuary for the New York State and Local Employees' Retirement
System.
