        AN  ACT  to  amend the vehicle and traffic law, in relation to requiring
          drivers to stop for pedestrians on sidewalks and in crosswalks
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 1151-a of the vehicle and traffic law, as added by
     2  chapter 603 of the laws of 1970, is amended to read as follows:
     3    § 1151-a. Pedestrians' right of way on sidewalks.   The  driver  of  a
     4  vehicle emerging from or entering an alleyway, building, private road or
     5  driveway  shall  [yield  the  right  of  way to] stop for any pedestrian
     6  approaching on any sidewalk extending  across  such  alleyway,  building
     7  entrance, road or driveway.
     8    §  2.  Subdivision (a) of section 1151 of the vehicle and traffic law,
     9  as amended by chapter 159 of the laws of 2002, is  amended  to  read  as
    10  follows:
    11    (a)  When traffic-control signals are not in place or not in operation
    12  the driver of a vehicle shall [yield the right of way, slowing  down  or
    13  stopping  if need be to so yield, to] stop for a pedestrian crossing the
    14  roadway within a crosswalk on the roadway  upon  which  the  vehicle  is
    15  traveling,  except  that  any  pedestrian  crossing a roadway at a point
    16  where a pedestrian tunnel or overpass has been provided shall yield  the
    17  right of way to all vehicles.
    18    § 3. This act shall take effect immediately.
