Go to top STATE OF NEW YORK ________________________________________________________________________ 7273 2023-2024 Regular Sessions IN ASSEMBLY May 16, 2023 ___________ Introduced by M. of A. L. ROSENTHAL -- read once and referred to the Committee on Housing AN ACT to amend the public housing law, in relation to requiring the New York city housing authority to provide written notice to residents of certain disruptions to water services and to establish certain guide- lines regarding the examination of water quality The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 402-e of the public housing law, 2 as amended by chapter 47 of the laws of 2020, is amended to read as 3 follows: 4 1. (a) In order to ensure compliance and enforcement of the New York 5 city housing authority's duty to provide heat, water, electricity and 6 elevator service, the New York city housing authority shall publish 7 information regarding reported disruptions in such services, the length 8 of such disruptions and the steps taken to restore services. Starting on 9 May first, two thousand twenty, the New York city housing authority 10 shall publish such information on its website. For six months after the 11 original publication date, the New York city housing authority shall 12 retain such information on its website. 13 (b) When a public utility or local, state or federal agency advises 14 the New York city housing authority that certain residents of such 15 authority should avoid the use of water for drinking or cooking, such 16 authority shall provide written notice, in electronic and paper form, of 17 such advice to the indicated residents and the resident association 18 president or other formally recognized resident leader for the indicated 19 development as soon as practical but no later than twenty-four hours 20 after such authority has received such advice. 21 § 2. Section 402-e of the public housing law is amended by adding a 22 new subdivision 1-a to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The New York city housing authority shall establish appropriate 2 measures, procedures, and guidelines, such as contract requirements and 3 enforcement mechanisms, to ensure that all of its contractors and 4 subcontractors, when collecting or examining water samples on behalf of 5 such authority, comply with all federal, state, and local laws, rules, 6 and regulations applicable to such collection or examination, including 7 the provisions of section five hundred two of the public health law. 8 § 3. This act shall take effect immediately.
