        Introduced by M. of A. DINOWITZ -- (at request of the Dormitory Authori-
          ty)  --  read  once  and  referred  to  the Committee on Corporations,
          Authorities and Commissions
 
        AN ACT to amend the public authorities law, in relation  to  authorizing
          the dormitory authority to finance stand-alone clinical facilities for
          various  human services organizations for whom the dormitory authority
          is currently authorized to issue bonds and notes
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. The undesignated paragraph of paragraph (b) of subdivision
     2  2 of section 1676 of the public authorities law, as added by chapter 373
     3  of the laws of 1998, is amended to read as follows:
     4    NYSARC,   Inc.   for   the   acquisition,   financing,    refinancing,
     5  construction,   reconstruction,  renovation,  development,  improvement,
     6  expansion, and equipping of clinical, day  programming  and  residential
     7  facilities and necessary ancillary and related facilities throughout the
     8  state.
     9    §  2.  The undesignated paragraph of paragraph (b) of subdivision 2 of
    10  section 1676 of the public authorities law, as added by chapter  369  of
    11  the laws of 2009, is amended to read as follows:
    12    Not-for-profit  members of the Alliance of Long Island Agencies, Inc.,
    13  for  the  acquisition,  financing,  refinancing,  construction,   recon-
    14  struction, renovation, development, improvement, expansion and equipping
    15  of  certain educational, administrative, clinical, day program and resi-
    16  dential facilities to be located in the state of New York.
    17    § 3. The undesignated paragraph of paragraph (b) of subdivision  2  of
    18  section  1676 of the public authorities  law, as added by chapter 471 of
    19  the laws of 2009, is amended to read as follows:
    20    Not-for-profit members of InterAgency Council  of  Mental  Retardation
    21  and  Developmental  Disabilities  Agencies,  Inc.,  for the acquisition,
    22  financing, refinancing, construction, reconstruction, renovation, devel-

     1  opment, improvement, expansion and  equipping  of  certain  educational,
     2  administrative,  clinical,  day program and residential facilities to be
     3  located in the state of New York.
     4    §  4.  The  undesignated paragraph of subdivision 1 of section 1680 of
     5  the public authorities law, as added by chapter 373 of the laws of 1998,
     6  is amended to read as follows:
     7    NYSARC,   Inc.   for   the   acquisition,   financing,    refinancing,
     8  construction,   reconstruction,  renovation,  development,  improvement,
     9  expansion, and equipping of clinical, day  programming  and  residential
    10  facilities and necessary ancillary and related facilities throughout the
    11  state.
    12    §  5.  The  undesignated paragraph of subdivision 1 of section 1680 of
    13  the public authorities law, as added by chapter 369 of the laws of 2009,
    14  is amended to read as follows:

    20  standing any other provision of law, not-for-profit members of the Alli-
    21  ance of Long Island Agencies, Inc. shall have full power  and  authority
    22  to  assign  and  pledge  to  the dormitory authority, any and all public
    23  funds to be apportioned or otherwise made payable by the United  States,
    24  any  agency thereof, the state, any agency thereof, a political subdivi-
    25  sion, as defined in section one hundred of the  general  municipal  law,
    26  any  social  services  district  in  the state or any other governmental
    27  entity in an amount sufficient to make all payments required to be  made
    28  by  such  members  pursuant  to  any  lease, sublease or other agreement
    29  entered into between such members and the dormitory authority. All state
    30  and local officers are hereby authorized and required to  pay  all  such
    31  funds  so  assigned  and pledged to the dormitory authority or, upon the
    32  direction of the dormitory authority, to any trustee  of  any  dormitory
    33  authority  bond or note issued, pursuant to a certificate filed with any
    34  such state or local officer by the dormitory authority pursuant  to  the
    35  provisions of this section.
    36    §  6.  The  undesignated paragraph of subdivision 1 of section 1680 of
    37  the public authorities law, as added by chapter 471 of the laws of 2009,
    38  is amended to read as follows:
    39    Not-for-profit members of InterAgency Council  of  Mental  Retardation

     4  authority pursuant to the provisions of this section.
     5    §  7.  This  act shall take effect immediately; provided, however that
     6  the amendments to the undesignated paragraph of paragraph (b) of  subdi-
     7  vision  2  of section 1676 of the public authorities law made by section
     8  one of this act and the  undesignated  paragraph  of  subdivision  1  of
     9  section  1680 of the public authorities law made by section four of this
    10  act shall not affect the repeal of such paragraphs pursuant to section 5
    11  of chapter 373 of the laws of 1998, as  amended,  and  shall  be  deemed
    12  repealed therewith.
