AN ACT to amend the labor law, in relation to membership of the state
apprenticeship and training council
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 813 of the labor law, as amended
2 by chapter 55 of the laws of 1992, is amended to read as follows:
3 1. The governor shall appoint a state apprenticeship and training
4 council, composed of three representatives from employer organizations
5 at least one of whom shall be a representative of an association with a
6 group non-joint apprenticeship program and three from employee organiza-
7 tions and one representative of the general public, who shall be the
8 chairman. The council by majority vote may designate one of its members,
9 other than the chairman, as vice-chairman to act in the absence or
10 inability of the chairman. Each member shall be appointed for a term of
11 three years. Each member shall hold office until his or her successor is
12 appointed and has qualified, and any vacancy shall be filled by appoint-
13 ment for the unexpired portion of the term. The present members of the
14 council shall continue to hold office until the expiration of their
15 present terms or their earlier terminations by resignation or inability
16 to act. The commissioner [of education], the commissioner of [labor]
17 education and the commissioner of economic development shall ex officio
18 be members of such council without vote. The members of the council
19 shall not receive a salary or other compensation, but shall be reim-
20 bursed for transportation and other expenses actually and necessarily
21 incurred in the performance of their duties under this article.
22 § 2. This act shall take effect immediately.
