        AN  ACT  to  amend  the  election  law,  in relation to time allowed for
          employees to vote
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Section 3-110 of the election law, as amended by section 1
     2  of part YY of chapter 55 of the laws of 2019,  is  amended  to  read  as
     3  follows:
     4    §  3-110.  Time  allowed employees to vote. 1. A registered voter may,
     5  without loss of pay for up to [three] two hours, take off so much  work-
     6  ing time as will enable him or her to vote at any election.
     7    2.  [The] If an employee has four consecutive hours either between the
     8  opening of the polls and the beginning of his or her working  shift,  or
     9  between  the  end  of  his  or  her working shift and the closing of the
    10  polls, he or she shall be deemed to have sufficient time outside his  or
    11  her  working hours within which to vote. If he or she has less than four
    12  consecutive hours, the employee shall be allowed  time  off  for  voting
    13  only at the beginning or end of his or her working shift, as the employ-
    14  er may designate, unless otherwise mutually agreed.
    15    3.  If  the  employee  requires  working time off to vote the employee
    16  shall notify his or her employer not more than ten  nor  less  than  two
    17  working days before the day of the election that he or she requires time
    18  off to vote in accordance with the provisions of this section.
    19    4. Not less than ten working days before every election, every employ-
    20  er shall post conspicuously in the place of work where it can be seen as
    21  employees  come or go to their place of work, a notice setting forth the
    22  provisions of this section. Such notice shall be kept posted  until  the
    23  close of the polls on election day.
    24    § 2. This act shall take effect immediately.
