        AN  ACT  to  amend  the  social  services  law, in relation to exempting
          amounts received from any financial settlement  for  childhood  sexual
          abuse for determining eligibility for or amount of benefits
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 131-n of the social services  law,  as  amended  by
     2  section  16  of part B of chapter 436 of the laws of 1997, is amended by
     3  adding a new subdivision 4 to read as follows:
     4    4. If and to the extent permitted  by  federal  law  and  regulations,
     5  amounts  received  from  any  financial  settlement for childhood sexual
     6  abuse shall be exempt from consideration as income or resources for  the
     7  purposes of determining eligibility for and the amount of benefits under
     8  any program provided under the authority of this chapter.
     9    §  2.  Section 131-n of the social services law, as amended by chapter
    10  635 of the laws of 1976, is amended by adding a  new  subdivision  3  to
    11  read as follows:
    12    3.  If  and  to  the  extent permitted by federal law and regulations,
    13  amounts received from any  financial  settlement  for  childhood  sexual
    14  abuse  shall be exempt from consideration as income or resources for the
    15  purposes of determining eligibility for and the amount of benefits under
    16  any program provided under the authority of this chapter.
    17    § 3. This act shall take effect immediately; provided that the  amend-
    18  ments to section 131-n of the social services law made by section one of
    19  this act shall be subject to the expiration and reversion of such subdi-
    20  vision  pursuant  to section 153 of part B of chapter 436 of the laws of
    21  1997 as amended, when upon such date the provisions of  section  two  of
    22  this act shall take effect.
