AN ACT to amend the vehicle and traffic law, in relation to requiring
the pre-licensing course to include information on organ and tissue
donation and how to register as an organ donor
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph (i) of paragraph (a) of subdivision 4 of
2 section 502 of the vehicle and traffic law, as amended by chapter 97 of
3 the laws of 2016, is amended to read as follows:
4 (i) Upon submission of an application for a driver's license, the
5 applicant shall be required to take and pass a test, or submit evidence
6 of passage of a test, with respect to the laws relating to traffic, the
7 laws relating to driving while ability is impaired and while intoxicat-
8 ed, under the overpowering influence of "Road Rage", or "Work Zone Safe-
9 ty" awareness as defined by the commissioner, the law relating to exer-
10 cising due care to avoid colliding with a parked, stopped or standing
11 authorized emergency vehicle or hazard vehicle pursuant to section elev-
12 en hundred forty-four-a of this chapter, the ability to read and compre-
13 hend traffic signs and symbols and such other matters as the commission-
14 er may prescribe, and to satisfactorily complete a course prescribed by
15 the commissioner of not less than four hours and not more than five
16 hours, consisting of classroom driver training and highway safety
17 instruction or the equivalent thereof, and shall also include informa-
18 tion on organ and tissue donation and how to register as an organ donor.
19 Such test shall include at least seven written questions concerning the
20 effects of consumption of alcohol or drugs on the ability of a person to
21 operate a motor vehicle and the legal and financial consequences result-

1 ing from violations of section eleven hundred ninety-two of this chap-
2 ter, prohibiting the operation of a motor vehicle while under the influ-
3 ence of alcohol or drugs. Such test shall include one or more written
4 questions concerning the devastating effects of "Road Rage" on the abil-
5 ity of a person to operate a motor vehicle and the legal and financial
6 consequences resulting from assaulting, threatening or interfering with
7 the lawful conduct of another person legally using the roadway. Such
8 test shall include one or more questions concerning the potential
9 dangers to persons and equipment resulting from the unsafe operation of
10 a motor vehicle in a work zone. Such test may include one or more ques-
11 tions concerning the law for exercising due care to avoid colliding with
12 a parked, stopped or standing vehicle pursuant to section eleven hundred
13 forty-four-a of this chapter. Such test shall be administered by the
14 commissioner. The commissioner shall cause the applicant to take a
15 vision test and a test for color blindness. Upon passage of the vision
16 test, the application may be accepted and the application fee shall be
17 payable.
18 § 2. Subparagraph (i) of paragraph (a) of subdivision 4 of section 502
19 of the vehicle and traffic law, as amended by chapter 355 of the laws of
20 2017, is amended to read as follows:
21 (i) Upon submission of an application for a driver's license, the
22 applicant shall be required to take and pass a test, or submit evidence
23 of passage of a test, with respect to the laws relating to traffic, the
24 laws relating to driving while ability is impaired and while intoxicat-
25 ed, under the overpowering influence of "Road Rage", "Work Zone Safety"
26 awareness and "Motorcycle Safety" awareness as defined by the commis-
27 sioner, the law relating to exercising due care to avoid colliding with
28 a parked, stopped or standing authorized emergency vehicle or hazard
29 vehicle pursuant to section eleven hundred forty-four-a of this chapter,
30 the ability to read and comprehend traffic signs and symbols and such
31 other matters as the commissioner may prescribe, and to satisfactorily
32 complete a course prescribed by the commissioner of not less than four
33 hours and not more than five hours, consisting of classroom driver
34 training and highway safety instruction or the equivalent thereof, and
35 shall also include information on organ and tissue donation and how to
36 register as an organ donor. Such test shall include at least seven
37 written questions concerning the effects of consumption of alcohol or
38 drugs on the ability of a person to operate a motor vehicle and the
39 legal and financial consequences resulting from violations of section
40 eleven hundred ninety-two of this chapter, prohibiting the operation of
41 a motor vehicle while under the influence of alcohol or drugs. Such test
42 shall include one or more written questions concerning the devastating
43 effects of "Road Rage" on the ability of a person to operate a motor
44 vehicle and the legal and financial consequences resulting from assault-
45 ing, threatening or interfering with the lawful conduct of another
46 person legally using the roadway. Such test shall include one or more
47 questions concerning the potential dangers to persons and equipment
48 resulting from the unsafe operation of a motor vehicle in a work zone.
49 Such test may include one or more questions concerning motorcycle safe-
50 ty. Such test may include one or more questions concerning the law for
51 exercising due care to avoid colliding with a parked, stopped or stand-
52 ing vehicle pursuant to section eleven hundred forty-four-a of this
53 chapter. Such test shall be administered by the commissioner. The
54 commissioner shall cause the applicant to take a vision test and a test
55 for color blindness. Upon passage of the vision test, the application
56 may be accepted and the application fee shall be payable.

1 § 3. This act shall take effect on the first of January next succeed-
2 ing the date on which it shall have become a law; provided, however,
3 that if chapter 355 of the laws of 2017 shall not have taken effect on
4 or before such effective date, then section two of this act shall take
5 effect on the same date and in the same manner as chapter 355 of the
6 laws of 2017 takes effect.
