          ordered reprinted, retaining its place on the order of third reading
 
        AN ACT to amend the public service law, in relation to net energy meter-
          ing for certain solar and wind electric generating systems
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  (d)  of  subdivision  1 of section 66-j of the
     2  public service law, as amended by chapter 355 of the laws  of  2009,  is
     3  amended to read as follows:
     4    (d)  "Solar electric generating equipment" means a photovoltaic system
     5  (i) (A) in the case of a residential customer, with a rated capacity  of
     6  not  more than twenty-five kilowatts; and (B) in the case of a non-resi-
     7  dential customer, with a rated capacity of not more than [the lesser of]

     8  two thousand kilowatts [or such customer's peak load  as  measured  over
     9  the  prior  twelve  month  period, or in the case that such twelve month
    10  period of measurement is  not  available,  then  as  determined  by  the
    11  commission  based  on  its  analysis of comparable facilities]; and (ii)
    12  that is manufactured, installed, and operated in accordance with  appli-
    13  cable  government and industry standards, that is connected to the elec-
    14  tric system and operated in conjunction with an  electric  corporation's
    15  transmission  and  distribution  facilities,  and  that  is  operated in
    16  compliance with any standards and requirements  established  under  this
    17  section.
    18    § 2.  Subparagraphs (i) and (iii) of paragraph (c) of subdivision 3 of
    19  section 66-j of the public service law, as amended by chapter 355 of the

    20  laws of 2009, are amended to read as follows:
    21    (i)  In  the  case  of a customer-generator who owns or operates solar
    22  electric generating equipment, micro-combined heat and power  generating

     1  equipment or fuel cell electric generating equipment located and used at
     2  his  or  her residence, or a non-residential customer-generator who owns
     3  or operates solar electric generating equipment with a rated capacity of
     4  not  more  than  twenty-five  kilowatts, up to a maximum amount of three
     5  hundred fifty dollars;

     6    (iii) In the case of a non-residential customer-generator who owns  or
     7  operates  solar  electric  generating equipment with a rated capacity of
     8  more than twenty-five kilowatts located and used at its  premises,  such
     9  cost  shall  be  as  determined  by  the electric corporation subject to
    10  review, upon the request of such customer-generator, by  the  department
    11  [pursuant to standards established thereby].
    12    §  3.  Paragraph  (f)  of  subdivision 1 of section 66-l of the public
    13  service law, as amended by chapter 483 of the laws of 2008,  is  amended
    14  to read as follows:
    15    (f) "Wind electric generating equipment" means one or more wind gener-
    16  ators  with a combined rated capacity of not more than twenty-five kilo-
    17  watts for a residential  customer-generator,  and  not  more  than  five

    18  hundred  kilowatts  for  a  farm service customer-generator, and [in the
    19  case of] not more than two  thousand  kilowatts  for  a  non-residential
    20  customer-generator[,  the  lesser  of  two  thousand  kilowatts  or  the
    21  customer-generator's peak load as measured over the prior  twelve  month
    22  period,  or  in the case that such twelve month period of measurement is
    23  not available, then as determined by the commission based on its  analy-
    24  sis  of  comparable  facilities];  that  is manufactured, installed, and
    25  operated in accordance with applicable government  and  industry  stand-
    26  ards,  that is connected to the electric system and operated in parallel
    27  with an electric corporation's transmission and distribution facilities,

    28  and that is operated in compliance with any standards  and  requirements
    29  established under this section.
    30    § 4. Subparagraphs (i), (ii) and (iii) of paragraph (c) of subdivision
    31  3  of  section 66-l of the public service law, as amended by chapter 483
    32  of the laws of 2008, are amended to read as follows:
    33    (i) in the case of a  residential,  farm  service  or  non-residential
    34  customer-generator with a combined rated capacity of not more than twen-
    35  ty-five  kilowatts,  up  to  a  maximum  amount  of  seven hundred fifty
    36  dollars; and
    37    (ii) in the case of a farm service customer-generator with a  combined
    38  rated  capacity of not more than five hundred kilowatts, up to a maximum
    39  of five thousand dollars; and
    40    (iii) in the case  of  a  non-residential  customer-generator  with  a

    41  combined  rated  capacity  of more than twenty-five kilowatts, such cost
    42  shall be as determined by the electric corporation  subject  to  review,
    43  upon the request of such customer-generator, by the department [pursuant
    44  to standards established thereby].
    45    § 5. This act shall take effect immediately.
