          Committee on Governmental Employees
 
        AN ACT to amend the retirement and social security law, in  relation  to
          eligibility for certain New York city transit authority members chang-
          ing to transit operating positions from other positions to participate
          in the twenty-five-year and age fifty-five retirement program
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision e of section 604-b of the retirement and social
     2  security law is amended by adding a new paragraph 12 to read as follows:
     3    12. Notwithstanding any other  provision  of  law  including,  without
     4  limitation, this section or section 13-161 of the administrative code of
     5  the  city  of  New York nor any prior resolution adopted by the New York
     6  city transit authority in accordance with such section of  the  adminis-
     7  trative  code of the city of New York, any transit annually-paid employ-
     8  ee, any transit annually-paid non-operating employee with prior  transit
     9  service and any subsequently appointed transit annually-paid non-operat-
    10  ing  employee, as such terms are defined by section 13-161 of the admin-
    11  istrative code of the city of New  York,  shall,  upon  transfer,  hire,
    12  promotion  or  other  employment  as  a  transit annually-paid operating
    13  employee, as such term is defined by section 13-161 of  the  administra-
    14  tive code of the city of New York, be eligible to elect participation in
    15  the retirement program set forth in this section.
    16    § 2. This act shall take effect immediately.
