        Introduced  by M. of A. PERRY -- read once and referred to the Committee

        AN ACT to amend the penal law, in relation to sentencing
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 3 of section 70.08 of the penal law, as amended

     2  by  section 7 of chapter 107 of the laws of 2006, is amended by adding a
     3  new paragraph (d) to read as follows:
     4    (d) For a class E felony the minimum period must  be  at  least  three
     5  years and must not exceed twenty-five years.
     6    §  2.  Subdivision  3 of section 70.08 of the penal law, as amended by
     7  section 8 of chapter 107 of the laws of 2006, is amended by adding a new
     8  paragraph (d) to read as follows:
     9    (d) For a class E felony the minimum period must  be  at  least  three
    10  years and must not exceed twenty-five years.
    11    §  3.  This  act shall take effect immediately; provided, however that
    12  this act shall apply to offenses committed on or  after  such  effective
    13  date;  and  provided  further  that  the  amendments to subdivision 3 of
    14  section 70.08 of the penal law made by section one of this act shall  be

    15  subject  to the expiration and reversion of such subdivision pursuant to
    16  subdivision d of section 74 of  chapter  3  of  the  laws  of  1995,  as
    17  amended,  when  upon such date the provisions of section two of this act
    18  shall take effect.
