AN ACT to amend the social services law, in relation to the modification
of competitively bid contracts
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 9 of section 365-l of the social services law,
2 as amended by section 35 of part C of chapter 60 of the laws of 2014, is
3 amended to read as follows:
4 9. The contract entered into by the commissioner of health prior to
5 January first, two thousand thirteen pursuant to subdivision eight of
6 this section may not be amended or modified without the need for a
7 competitive bid or request for proposal process, [and] or without regard
8 to the provisions of sections one hundred twelve and one hundred sixty-
9 three of the state finance law, section one hundred forty-two of the
10 economic development law, or any other provision of law[, to allow the
11 purchase of additional personnel and services, subject to available
12 funding, for the limited purpose of assisting the department of health
13 with implementing the Balancing Incentive Program, the Fully Integrated
14 Duals Advantage Program, the Vital Access Provider Program, the Medicaid
15 waiver amendment associated with the public hospital transformation, the
16 addition of behavioral health services as a managed care plan benefit,
17 the delivery system reform incentive payment plan, activities to facili-
18 tate the transition of vulnerable populations to managed care and/or any
19 workgroups required to be established by the chapter of the laws of two
20 thousand thirteen that added this subdivision].
21 § 2. This act shall take effect immediately and shall be deemed to
22 have been in full force and effect on and after April 1, 2014.
