        AN  ACT  to  amend  the  environmental  conservation law, in relation to
          requiring all new outdoor lighting to be solid-state lighting
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.  The environmental conservation law is amended by adding a
     2  new article 20 to read as follows:
     3                                 ARTICLE 20
     4                        SOLID-STATE OUTDOOR LIGHTING
     5  Section 20-0101. Definitions.
     6          20-0103. Solid-state outdoor lighting required.
     7  § 20-0101. Definitions.
     8    When used in this article:
     9    1. "Lamp" means the component of a luminaire that  produces  light;  a
    10  light bulb.
    11    2.  "Light  emitting  diode" or "LED" is a semi-conducting device that
    12  produces light when an electrical current flows through it.
    13    3. "Luminaire" means a complete lighting unit,  including  a  lamp  or

    14  lamps together with the parts designed to distribute the light, to posi-
    15  tion  and  protect  the  lamps,  and  to  connect the lamps to the power
    16  supply; a light fixture.
    17    4. "Organic light-emitting diodes" or "OLEDs" are LEDs based on organ-
    18  ic materials.
    19    5. "Solid-state lighting" means lamps that are  either  light-emitting
    20  diodes or organic light emitting diodes. Such lamps shall:
    21    (a)  Have  minimum  operating temperatures between minus forty degrees
    22  Celsius and forty-five degrees Celsius;
    23    (b) Have operating voltages of one hundred twenty to two hundred thir-
    24  ty volts AC/DC;
    25    (c) Be dimmable with no color shift (>200deg K);

     1    (d) Have a minimum published life of twenty-five thousand hours;
     2    (e) Have a minimum warranty of five years, or three years for MR 16s;
     3    (f) Be damp location rated (IL 1993 and UL 8750);
     4    (g)  Have a lumen maintenance figure over the warranty period at least
     5  seventy percent;
     6    (h) Have binning ranges less than one hundred degrees below thirty-one
     7  hundred Kelvin and no more than two hundred thirty degrees  above  thir-
     8  ty-one hundred Kelvin using the four step McAdams method;

     9    (i) Have a power factor of at least seventy-five percent;
    10    (j) Have a class A minimum rating for electrical noise;
    11    (k)  Have form factors that meet ANSI specifications for standard lamp
    12  configurations;
    13    (l) Meet or exceed energy star specifications over the warranty period
    14  for lumen color shift;
    15    (m) Meet energy start guidelines for such lamp type;
    16    (n) Be manufactured by a manufacturer that shall:
    17    (i) Demonstrate at least five years of production history;
    18    (ii) Be an energy star partner; and
    19    (iii) Own a research and development facility.
    20    (o) Be mercury and lead-free and recyclable; and
    21    (p) Have a United States department of energy lighting facts label.

    22  § 20-0103. Solid-state outdoor lighting required.
    23    No state agency or public corporation, as defined in section sixty-six
    24  of the general construction law, operating in the state shall install or
    25  cause to be installed any new or replacement permanent outdoor luminaire
    26  unless such luminaire utilizes solid-state lighting.
    27    § 2. This act shall take effect on the one hundred twentieth day after
    28  it shall have become a law. Effective immediately, the addition,  amend-
    29  ment and/or repeal of any rule or regulation necessary for the implemen-
    30  tation  of this act on its effective date is authorized to be made on or
    31  before such date.
