        AN  ACT to amend the vehicle and traffic law, in relation to authorizing
          a residential parking system in the town of North Hempstead
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Legislative findings and intent. The legislature finds that
     2  a  lack  of  parking for residents of certain areas of the town of North
     3  Hempstead, Nassau county, has resulted in  traffic  hazards,  congestion
     4  and  air  and noise pollution. In addition, such lack of parking poses a
     5  hazard to residents and other pedestrians in such areas.
     6    The legislature further finds that a residential parking system within
     7  such areas would be in the  public  interest.  The  legislature  further
     8  finds  that  a  residential parking system within such areas will reduce
     9  such hazards and will reduce pollution levels as well. The  legislature,
    10  therefore,  hereby  declares  the necessity of this act to authorize the
    11  town of North Hempstead to adopt a residential parking permit system  in
    12  accordance with the provisions of this act.
    13    §  2.  The  vehicle and traffic law is amended by adding a new section
    14  1662-f to read as follows:
    15    § 1662-f. Residential parking system in the town of  North  Hempstead.
    16  1.  Notwithstanding  the provisions of any law to the contrary, the town
    17  board of the town of North Hempstead may, by adoption of a local law  or
    18  ordinance,  provide  for a residential parking permit system and fix and
    19  require the payment of fees applicable to parking  within  the  area  in
    20  which such parking system is in effect in accordance with the provisions
    21  of this section.

     1    2.  Such  residential  parking  permit  system may only be established
     2  within the area known as Manhasset of the town consisting of the roadway
     3  Bayview Court.
     4    3. Notwithstanding the foregoing, no permit shall be required on those
     5  portions  of  such  street  where  the adjacent properties are zoned for
     6  commercial/retail use.
     7    4. The local law or ordinance providing for such  residential  parking
     8  system shall:
     9    (a)  set  forth  factors  necessitating  the enactment of such parking
    10  system;
    11    (b) provide that motor vehicles registered pursuant  to  section  four
    12  hundred  four-a of this chapter shall be exempt from any permit require-
    13  ment;
    14    (c) provide the times of day and days of the week during which  permit
    15  requirements shall be in effect;
    16    (d) make not less than fifteen percent of the spaces within the permit
    17  area  available to nonresidents, and shall provide short term parking of
    18  not less than sixty minutes in duration in the permit area;
    19    (e) provide the schedule of fees to be paid for such permits; and
    20    (f) provide that such fees shall be credited to the  general  fund  of
    21  the  town  of  North  Hempstead unless otherwise specified in such local
    22  law.
    23    5. No ordinance shall be adopted pursuant  to  this  section  until  a
    24  public  hearing  thereon has been had in the same manner as required for
    25  public hearings on local law pursuant to the municipal home rule law.
    26    6. The provisions of this section shall not apply to any state highway
    27  maintained by the state.
    28    § 3. This act shall take effect immediately.
