AN ACT to amend the general municipal law, in relation to burial of
indigent veterans of the armed forces of the United States
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 148 of the general municipal law is amended by
2 adding a new subdivision 1-a to read as follows:
3 1-a. Notwithstanding any other provision of this section, in the case
4 of an indigent veteran who died in a county or the city of New York
5 leaving no funds or insurance sufficient to pay funeral and burial
6 expenses of such veteran and such veteran has no next of kin or person
7 of record previously designated to control his or her final disposition
8 pursuant to section four thousand two hundred one of the public health
9 law, such county or the city of New York may request a congressional
10 chartered veterans' organization within the county or the city of New
11 York where the decedent resided at the time of death, to engage the
12 services of a funeral firm to conduct the funeral and burial services.
13 Such organization shall incur the costs associated with such services,
14 which shall include but not be limited to, the purchase of a suitable
15 container for burial, the funeral director's prices for merchandise and
16 services furnished, cost of a grave site and a military funeral service
17 at the cemetery to which such body shall be interred. The state shall
18 reimburse such congressional chartered veteran organization for such
19 funeral and burial service expenses for indigent veterans, except those
20 expenses previously reimbursed pursuant to section one hundred forty-one
21 of the social services law or any other law or those expenses reimbursa-
22 ble or payable by the federal government; provided however, that the

1 total reimbursement pursuant to this subdivision shall not exceed two
2 thousand dollars per burial.
3 § 2. This act shall take effect on the ninetieth day after it shall
4 have become a law.
