        Introduced  by M. of A. GUNTHER, LIFTON, BURLING, PALMESANO -- read once
          and referred to the Committee on Higher Education
 
        AN ACT to amend the education law, in relation to the provision of nurs-
          ing level care under a registered nurse's supervision
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.  Clause  (iii)  of paragraph a of subdivision 1 of section
     2  6908 of the education law, as amended by chapter  160  of  the  laws  of
     3  2003, is amended to read as follows:
     4    (iii)  the  providing  of  care  by  a person acting in the place of a
     5  person exempt under clause (i) of this  paragraph,  but  who  does  hold
     6  himself or herself out as one who accepts employment for performing such
     7  care,  where  nursing  services  are under the instruction of a licensed
     8  registered professional nurse, or under the instruction of a patient  or
     9  family or household member determined by a registered professional nurse
    10  to  be self-directing and capable of providing such instruction, and any
    11  remuneration is provided under section three hundred sixty-five-f of the

    12  social services law or for services under an entity certified,  approved
    13  or licensed under article thirty-six of the public health law; or
    14    § 2. This act shall take effect immediately.
